Statement From EPSA President and CEO Todd Snitchler
WASHINGTON, D.C. – Today the Electric Power Supply Association (EPSA) called on the Federal Energy Regulatory Commission (FERC) to reject a proposal filed by PJM Interconnection to change capacity market auction rules after its most recent auction. EPSA filed its protest on Friday afternoon with an expert affidavit from Dr. Paul Sotkiewicz in response to the December 23, 2022, PJM section 205 and section 206 filings to revise its RPM Locational Deliverability Area Reliability Requirements during the December Base Residual Auction for the 2024/2025 Delivery Year, for which results had been slated for announcement December 20.
EPSA President and CEO Todd Snitchler issued the following statement:
“FERC must reject these misguided filings by PJM. The long-term negative impacts on the market and the negative effect on investor confidence in the PJM market for projects due to the possibility of arbitrary changes to auction results is exactly the wrong signal to send if we want a reliable power system. Further, PJM’s filings would contravene the long- established filed rate doctrine and rule against retroactive ratemaking which are fundamental to the well-ordered operation of the market. As has been its practice in the past, if PJM identifies a need for a change in its tariff it should consult with stakeholders and make a prospective filing to adjust it, not attempt to shoehorn in a momentous change that impacts all market participants after the auction is all but complete simply because it does not like the auction outcome.”
