On Tuesday, EPSA filed the attached Answer in Docket Nos. EL15-70 et al at FERC. EPSA’s Answer supports Dynegy’s (Vistra’s) motion to amend the paper hearing procedures set out in the June 16 Remand Order and argues that the current procedures outlined would not provide sufficient time to review the extensive amount of documents that parties to the earlier portion of this proceeding and that the closed FERC investigation would need to support any necessary claims of confidentiality and privilege with respect to each document.

On August 8, 2022, the Electric Power Supply Association filed a supplemental petition for review of the FERC’s PJM ORDC Orders in the 6th Circuit Court of Appeals (Case No. 22-3666). EPSA filed the supplemental petition for review to encompass the July 28, 2022 PJM Order Addressing Rehearing Requests that issued after EPSA filed its previous petition, and requests that the court consolidate this matter with the pending Case No. 22-3176.
