Case No. 20-1156
In the United States Court of Appeals for the District of Columbia Circuit
PUBLIC CITIZEN, INC., Petitioner, vs. FEDERAL ENERGY REGULATORY COMMISSION, Respondent
BRIEF OF THE ELECTRIC POWER SUPPLY ASSOCIATION AS
AMICUS CURIAE SUPPORTING RESPONDENT
EPSA filed in support of FERC’s orders dismissing complaints challenging the results of 2015/2016 MISO’s Zone 4 capacity auction explaining that Petitioner Public Citizen falsely conflates rate, which here is the sellers’ market-based rate authorizations and the FERC-approved auction rules, with the auction price, and how Petitioner’s view would upend FERC’s market-based rate regime. It further observes that the price spike observed in this auction was a natural result of MISO’s use of a vertical demand curve.
