EPSA Answer in FERC PJM Resource Reliability Initiative Proceeding

By EPSA

EPSA Defends PJM Resource Reliability Initiative Against Environmental Law And Policy Center Complaint, Rebuts Jurisdictional Claims in FERC Filing

Date filed:       January 23, 2025

Venue:          Federal Energy Regulatory Commission

Docket No.:          EL25-712-000

On January 23, 2025, the Electric Power Supply Association (EPSA) filed an answer with the Federal Energy Regulatory Commission (FERC) addressing a protest by the Environmental Law & Policy Center (ELPC) concerning PJM Interconnection’s Resource Reliability Initiative (RRI). The ELPC argued that the proposal infringes on state authority to decide the resource mix for the grid—a claim also raised in a letter from the National Caucus of Environmental Legislators (NCEL).

EPSA’s filing refutes these jurisdictional concerns, emphasizing that they lack merit, and urges FERC to approve the PJM RRI as a reasonable measure to mitigate the risk of a potential capacity shortage.

Former FERC Chairman Joe Kelliher’s affidavit, included in EPSA’s prior comments, also addressed these issues. EPSA’s latest response focuses specifically on countering the arguments from ELPC and NCEL.
