INITIAL BRIEF OF THE ELECTRIC POWER SUPPLY ASSOCIATION

EPSA’s brief explains that the Commission lacks the authority to contemplate modifications to a Certificate Order issued four years ago, upheld on rehearing, affirmed by the U.S. Court of Appeals, and approved for service via Letter Order nearly six months ago. To reopen this Certificate at this stage is wholly inconsistent under authorizing statute and would set troubling precedent endangering regulatory finality needed by investors and consumers alike.
