Summary:
On April 17, 2023, the Electric Power Supply Association (EPSA) joined seven other associations (“Trade Associations”) on a protest filed at the Federal Energy Regulatory Commission (“Commission”) responding to the March 24, 2023, PJM Independent Market Monitor (“Market Monitor) Complaint against PJM (EL23-50). The Market Monitor Complaint seeks participation at the Liaison Committee meetings with the PJM Board. The Trade Associations argue that the Market Monitor’s Complaint has not met its burden pursuant to section 206 of the Federal Power Act (“FPA”). Further, the protest explains the Market Monitor failed to demonstrate any violation by PJM of Commission precedent, its Tariff or Operating Agreement, or any applicable rules, laws, and procedures, with respect to its stakeholder processes and in particular, the conduct of its Liaison Committee. Accordingly, the protest argues that the Market Monitor’s request that the Commission direct PJM to permit the Market Monitor to fully participate in Liaison Committee meetings should be denied and its Complaint should be dismissed. In addition to EPSA, the associations joining the protest include P3, SEIA, ACP, NEI, NHA, AEU and ACORE.
