Summary: EPSA filed a limited protest objecting to MISO’s proposed exemption for projects from Relevant Electric Retail Regulatory Authorities (RERRA). This exemption would all an RERRA to request that a proposed generating facility be exempt from MISO queue cap, which adds those RERRA designated MWs to the overall cap quantity for one cycle. EPSA argues that this exemption is unjust, unreasonable, and unduly discriminatory, and would establish a flawed policy because it: 1) violates open access principles, 2) contains no limitations or guardrails regarding the size or quantity of state-supported projects that may be submitted under this exemption; and 3) essentially allows MISO and the relevant RERRA to pick winners and losers.
