Summary: On January 21, 2025, the Electric Power Supply Association (EPSA) filed a protest and affidavit of Paul M. Sotkiewicz, Ph.D., calling for denial of the Pennsylvania Governor Josh Shapiro’s complaint against PJM seeking a lower capacity market price cap (i.e., from 1.75 to 1.5 times Net CONE) for the next two base residual auctions (BRAs). The EPSA protest and affidavit explain the reasons the complaint should be denied. Specifically, the complaint (1) does not satisfy the burden to demonstrate that the existing rate is not just and reasonable; (2) the replacement rate submitted in the complaint is not just and reasonable; and, (3) the Governor of Pennsylvania may not have the authority to bring the complaint on behalf of the Commonwealth of Pennsylvania.
