Summary:
On March 29, 2023, EPSA filed at protest in response to the Federal Energy Regulatory Commission’s (“FERC” or “Commission) March 17, 2023, Show Cause Order in EL23-46-000 directing the Midcontinent Independent System Operator, Inc. (“MISO”) to explain or revise a 2023/2024 Planning Resource Auction (“PRA”) ratio and MISO’s March 24, 2023, Answer that it will revise the ratio prior to the PRA. EPSA requests that the Commission reject MISO’s proposal to update the ratio in advance of the 2023/2024 PRA and immediately terminate the proceeding in order to restore certainty to the MISO market. Of note, MISO concurrently filed a request for prospective waiver of certain timing requirements for the 2023/2024 PRA in Docket No. ER23-1465-000, which the Commission unanimously approved in a March 28, 2023, Order.
