EPSA Reply to 7th Circuit on Responses Regarding Motion to Transfer MOPR Appeals

Intervenor Electric Power Supply Association’s Reply in Support of its Motion to Transfer

EPSA replies to three responses filed at the 7th Circuit appeals court on the Motion to Transfer MOPR Petitions from the 7th Circuit (CA7) to the DC Circuit (CADC). There are 27 petitions for review regarding the same FERC orders pending at the 7th Circuit and DC Circuit courts; these petitions need to be consolidated at one of the courts.  EPSA highlights that both FERC and environmental NGOs agreed. EPSA rebuts the ICC’s characterization that the motion is a means to forum shop or a request that the court “reverse” the MDL lottery decision.
